These Terms of Service ("Terms") govern your use of yourbenefitspath.com and its Services, operated by Your Benefits Path ("we," "us," "our"). By using the Site, you agree to these Terms, our Privacy Policy, Disclaimer, and Disclosures. If you do not agree, do not use the Site.
1. What we provide
We provide educational information, checklists, and guides based on general rules for VA disability and Social Security Disability claims. We are not the VA or SSA, not a law firm, not a medical provider, and not a claims representative. See the Disclaimer for the full scope and limits of the Services.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services.
3. Your responsibilities
- Provide accurate information.
- Use the Services for your own personal, lawful purposes.
- Do not misuse the Site: no scraping, reverse engineering, interfering with security, uploading malicious code, or using the Services to harass others or violate any law.
- You are responsible for your own claim, your submissions to the VA or SSA, and meeting all deadlines.
4. No professional relationship; no guarantee
Using the Services does not create an attorney-client, agent, or medical relationship. We do not guarantee any claim outcome, rating, approval, or benefit amount. Any professional we connect you with is independent and responsible for their own services.
5. Intellectual property
The Site, its content, and design are owned by Your Benefits Path or our licensors and are protected by law. We grant you a limited, personal, non-transferable license to use the Site and the checklists we provide you. You may not resell, republish, or commercially exploit our content without permission.
6. Your content
You retain ownership of the information and free-text you submit. You grant us a license to use it to provide the Services (including delivering your checklist and, with your consent, matching you with a partner). You represent that you have the right to share what you submit.
7. Third-party services and referrals
We may connect you with independent third-party professionals and may earn compensation for referrals, as described in our Disclosures. We do not control and are not responsible for third parties or their services. Any agreement you make with them is solely between you and them.
8. Disclaimers of warranties
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that information is complete or current.
9. Limitation of liability
To the fullest extent permitted by law, Your Benefits Path and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost benefits, denied or delayed claims, or lost data, arising from your use of the Services. Our total liability for any claim will not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless Your Benefits Path from claims, damages, and expenses arising out of your misuse of the Services or violation of these Terms.
11. Termination
We may suspend or terminate access to the Services at any time, for any reason, including violation of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in [STATE], unless otherwise required by law. [Optional: arbitration / class-action-waiver clause to be added on counsel's advice.]
